Terms of Service

Acceptance of these Terms

By creating a Kiwiq account or using Kiwiq's website, dashboard, or tracking snippet (together, the “Service”), you agree to these Terms of Service. If you don't agree, please don't use the Service.

If you're using Kiwiq on behalf of a company or other organization, you confirm that you have the authority to bind that organization to these Terms.

The Service

Kiwiq provides a lightweight JavaScript snippet and dashboard for measuring impressions, clicks, and other interactions with elements on your website. Kiwiq is under active development, and features, limits, and availability may change as the product evolves.

Your account

You're responsible for keeping your account credentials confidential and for all activity that happens under your account. Let us know right away if you suspect unauthorized use of your account.

You must provide accurate information when creating an account, and you must be legally able to enter into these Terms.

Acceptable use

You agree not to use Kiwiq to track websites you don't have the right to track, to collect data unlawfully, or to circumvent the rate limits or security of the Service.

If you use Kiwiq's tracking snippet on your own website, you're responsible for having a valid legal basis to track your visitors and for maintaining your own privacy policy — see our Privacy Policy for how this responsibility is split between you and Kiwiq.

API keys

Each project has a public API key used to identify which project an event belongs to. It's not a secret and is safe to include in client-side code, but you're still responsible for the projects and data associated with your account.

Fees

Kiwiq is currently offered free of charge. We may introduce paid plans in the future; if we do, we'll give you notice before any changes affect your account.

Your data

You retain ownership of the data collected through your use of Kiwiq. We process it as described in our Privacy Policy, and only as needed to provide the Service to you.

Intellectual property

Kiwiq, its logo, website, dashboard, and SDK are our intellectual property. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service as intended.

Termination

You can stop using Kiwiq and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

On termination, we'll delete or anonymize your account data within a reasonable time, except where we need to retain it for legal reasons.

Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We don't guarantee that the Service will be uninterrupted, error-free, or available at all times, particularly given Kiwiq's current stage of development.

Limitation of liability

To the extent permitted by law, Kiwiq is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you've paid us in the preceding 12 months, if any.

Changes to these Terms

We may update these Terms as Kiwiq evolves. If we make material changes, we'll let you know — for example, by updating the date at the top of this page or notifying you directly.
